The following terms and conditions, govern your access to any use of dionysiadesigns.com, including any content, functionality, and services offered on or through dionysiadesigns.com.

Please read the Terms of Service carefully before you start to use dionysiadesigns.com. By using the website, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the website dionysiadesigns.com.

CONFIDENTIALITY

Client information is confidential. Any information shared to dionysiadesigns.com is for the purpose of quoting and services. All information or assets are confidential with third parties unless specified directly by the client. 

PUBLISHING RIGHTS

It is the client’s responsibility when providing materials in which they have permission to use to ensure that they are without copyright or permission infringements. The client agrees that should any copyright or permission infringement action occur dionysiadesigns.com will not be held liable. 

OWNERSHIP RIGHTS

Upon final receipt, dionysiadesigns.com grants the client exclusive license to use the final version of the cover design. dionysiadesigns.com provides pdf, jpg, png, or other publishing-ready format for the final product.

Dionysiadesigns.com does not provide source files and client agrees that they have no rights to alter the final designs in any way with the exception of resizing for production and display. If the client wants any alterations after the delivery of the final payment and the final design files, the client understands that additional payments may be required.

Dionysiadesigns.com retains the right to use the final book cover design for dionysiadesigns.com marketing and promotional purposes. Copyright and ownership of all draft design materials belongs to dionysiadesigns.com.

Client is responsible for securing the rights to use any client supplied materials that are subject to intellectual property rights by a third-party. Client assumes full legal and financial responsibility for any dispute involving materials the client has provided to dionysiadesigns.com.

CLIENT RESPONSIBILITIES

The client is personally responsible for requesting a proof from their printer prior to publishing. Dionysiadesigns.com will not be held financially or legally responsible for expenses or problems related to use of the cover design, formatting design, or marketing design. The client must provide dionysiadesigns.com with the appropriate information for the final print-ready book cover file by obtaining the file or the link to the template provided by the client’s publisher or printer.

PAYMENT

The client agrees to pay 40% of the fees associated with the project prior to commencement of work for custom projects. The remaining balance is due upon final cover design approval. Dionysiadesigns.com will not release final files to the client or third parties until the final balance has been paid in full. The final payment also signals final approval of the project by the client, at which point, the final files will be released to the client and this contract will be considered fulfilled.Dionysiadesigns.com has the right to suspend services to client should payments not be paid as specified in this agreement.

CANCELLATION POLICY

If the client provides written request to cancel the project before payment the project will be considered canceled. If work has been started and a deposit has been made, they agree to forfeit the deposit already paid to cover the cost of resources and design time taken up to the point of project cancellation. Client agrees to discard any mock-ups shared with the client and client shall have no rights to any mock-ups, images, or design materials created prior to cancellation. Repeated cancellations may result in dionysiadesigns.com no longer working with a client. 

COMPLETE AGREEMENT

Agreement constitutes the entire agreement between all parties concerning the subject matter hereof. There are no warranties, representations, covenants or agreements, expressed or implied, between the parties except those expressly set forth in this agreement. Any amendments or modifications of this agreement shall be in writing and executed by the contracting parties.

REFUND POLICY

All purchases are final, non-refundable, and provide you with a single, exclusive use license to the book cover, formatting, marketing services, design. All products are one time sales and will not be used again. 

CHANGES TO TERMS

Dionysiadesigns.com holds the right to change these terms and conditions at any time. Any changes will result in an updated date listed beside “last updated”. Continued use of our services constitutes your acceptance of the revised terms and conditions.
